I have represented a number of Nigerian client’s seekers claiming asylum on the basis of their sexual orientation. Often these are normal people looking to mind their business and get on with life. In all these people I have met there is always one thing that run through their story – they live on the margins of society. Their demeanour will usually give it all out. you find their confidence level low or shot into pieces. The reason for this is the hostility and intense anti – LGBT+ sentiment directed at them.

If you ask a gay person what is or are their fears; violence directed to them is a daily phenomenon. Everyone knows somebody who has lost his life because of violence and in discriminated attacks on LGBT persons or suspected person. General altitude to homosexuality is abhorrence which means for the people even in times of difficulty there is hardly anybody to fall on. You cannot report an attack to the police because will could be arrested treated as a criminal, you cannot report to the family because you will be blowing your cover as taking part in evil which cannot be entertained or accepted.

Nigeria has never been receptive to homosexuality; however, the introduction of the Same – Sex Marriage (prohibition) Act in 2014; fundamentally changed it all. This law criminalizes the lives of gay and lesbian people, but the damage it would cause extends to people attitude to LBTQ minority.

This law has served to further marginalize an already stigmatized population, driving them underground and imperiling their rights and their health.

The law imposes a 14-year prison sentence

• on anyone who “[enters] into a same-sex marriage contract or civil union,”
• a 10-year sentence on individuals or groups, including religious leaders, who “witness, abet, and aid the solemnization of a same-sex marriage or union.”
• imposes a 10-year prison sentence on those who “directly or indirectly make a public show of a same-sex relationship and anyone who “registers, operates, or participates in gay clubs, societies, and organizations,” including supporters of those groups

Human Right watch and civil societies in Nigeria have since observed that the law is making it difficult for LGTB persons to access support services as no body or group of persons wants to be accused of a crime for associating or operating with LGTB+ group.

Nigeria has the world’s third-largest number of people living with HIV/AIDS, and its National Agency for the Control of AIDS has recognized the need to target vulnerable groups in HIV/AIDS outreach efforts, including people who engage in same-sex conduct. The law will hinder their efforts by criminalizing those who conduct outreach to LGBT groups. By banning undefined “gay meetings,” it could also criminalize programs funded by major donors that provide education on HIV prevention and health for men who have sex with men.

Clients I have acted have often cited access to health facilities as one of their biggest challenge as they would not be allowed to access facilities if it turns out they are gays. The law contradicts fundamental freedoms under international human rights treaties and standards, which the Nigerian Constitution incidentally also guarantees. The Nigerian Constitution, under section 40, guarantees that: “Every person shall be entitled to assemble freely and associate with other persons, and in particular he may form or belong to any political party, trade union, or any other association for the protection of his interests. Section 17 affirms that “every citizen shall have equality of rights, obligations, and opportunities before the law.”

UK government recognizes the situation of LGBT+ minority in Nigeria and considers application for Asylum and protection on the basis of sexual orientation.

Depending on the category of visa you are on you should be able to secure an Indefinite Leave to Remain after either 5 or 10 years’ of living in the UK continuously and lawfully. ILR means there will be no time restrictions on your right to live and work in the country. You can also start and run your own business.

Additional requirement

Other than being on a specific route the immigration rules also set a detail requirement that each application must meet to be awarded ILR.

English Language Requirement

You will have to prove that your English speaking and listening ability is at or above level B1 under the Common European Framework of Reference for Language (CEFR). Over 65s are exempted from this requirement, so are nationals from a few countries that the UK considers Majority English speaking Countries. Life in the UK Test

You will also be required to take the life in the UK test to qualify for ILR. The life in the UK test is a test of your understanding of the life and culture of the UK. A few people are exempted including people with proof of learning difficulties or medical conditions that may make it difficult to take or pass the test. There are online materials and apps that can help you to pass this test. We have seen a significant number of people prepare and pass this test in 2 weeks with the right materials. Prove you are financially able to support yourself & any dependants.

You can use your earning or savings to do this. You need to demonstrate that you have sufficient savings/earnings to support yourself and your family.

Continue to meet your specific visa requirement.

This means that for the 5 years period you have lived in the UK you have complied with all the terms of your visa and continue to meet those terms. Any breach without valid reasons could ruin your chances of being granted ILR. Always discuss your circumstances with an expert where you think there is a situation that could potentially be interpreted as a breach of the terms of your visa.

Who can apply under appendix fm?

1. Partners – a partner is define here to mean
   1. Spouse
   2. Civil partners
   3. Unmarried partners (living pretty much like married couple)

A partner’s application under appendix fm must be supported by a sponsor. The sponsor can be either a British Citizen, a person with permanent residence in the UK or a holder of a refugee status.

In addition to the above an applicant must also show they meet a language, relationship and a financial requirement (of £18,600). The Home office will also undertake a background check to ensure the applicant has no adverse history to be considered undesirable to be allowed to come to the UK (Suitability grounds). Past convictions and deceptions would be barriers.

2. Parents –

To apply or submit an application as a parent under appendix fm is to say that you intend to enter or remain in the UK on the basis of your parental status.  You will have to provide evidence that you have either (i) sole parental responsibility for the child; or(ii) can access rights to the child, and that you are taking, and intend to continue to take, an active role in the child’s upbringing.

3. A child with a limited leave

In order for a child to enter the UK to join a parent in the UK, one of the requirements is that the parent shows that he/she has sole responsibility for the child’s upbringing. A parent will be considered to have sole responsibility for the child if he/she takes the important decisions in the child’s life and is responsible for the overall direction of the child’s upbringing.

4. An adult dependent relative

Dependents over the age of 18 who are living overseas and require long term care to do every day personal and household tasks may apply under the adult dependent relative route if they can demonstrate that, as a result of age, illness or disability they require the level of long term personal care that can only be provided in the UK by the relative here and without recourse to public funds.

5. Victims of domestic violence

A victim of domestic violence, who entered the UK as a spouse, civil partner or unmarried partner, can apply for indefinite leave to remain if it can be shown that his/her relationship was caused to permanently break down as a result of domestic violence. Domestic violence can take the form of either physical or emotional abuse. We can help gather the evidence to show abuse. We may decide to instruct clinical experts to help show abuse if this is deemed necessary.

Cost

Appendix fm applications can be very expensive. Usually you will have to pay for an application fee and then NHS fees. This is one of the reason is always good to seek expert advice so you know you are doing the right thing and don’t have to return to pay those fees again.

Fee Waiver

If you are extending your visa under appendix, it’s possible to get the home office to wave the application and NHS fees. Your will have to prove to them indeed you are unable to pay for the cost of the application. Again a lawyers’ assistance in this regard can be valuable.

Unlike other areas of immigration law, British Nationality is not a ‘right’ nor an‘entitlement’, but a matter of law which can be granted or refused at the Home Secretary’s discretion. The application process will ask you to satisfy certain criteria, however it is for the Home Secretary to decide whether these criteria can be bypassed in certain situations.

Normally if you have live in the UK for a period of 5 years or more (in some cases 3 years) you may qualify for British Citizenship. There is no obligation to become a British but for most people having make the UK their home they also feel its good to acquire British Nationality.

How about my Original Nationality?

British Nationality Law allows individuals to hold multiple Nationalities. This means you would not have to drop any nationality that you already own. It is however important to investigate whether the other nationalities you have also allows you to pick up the nationality of other countries.

Forms of Nationality

There are 2 main ways by which a national of a third party National can acquire British Nationality:

• Naturalization
• Registration

British Nationality by Naturalization; this allows a person who entered the UK as an adult to apply after 5 years or more to become a British Citizen. To apply for Naturalization you will first have to achieve settlement in the UK – UK resident with no border restriction.

British Nationality by Registration; this apply mainly to children and with children there is no requirement to be settled. All that an applicant has to do is provide evidence to show he or she has a parent with a settlement status or a British National. Registration is very interesting because it allowed children with varied degree of relationships to be registered as British citizens.

How do I make an application for Naturalization as an adult

You must be able to prove that you are free of immigration time restrictions. This means that you must have either Indefinite Leave to Remain in the UK (non–EEA nationals) or Permanent Residence (EEA Nationals). If you are not the spouse of a British citizen, you must also prove that you have been free of those restrictions for the past 12 months. This means that if you were granted ILR, you must have been granted it at least 12 months ago, and if you are an EEA National, you must have completed your continuous period of 5 years at least 12 months ago.
The application also requires you to meet certain residency and absences requirements. The other criteria to be satisfied are, namely, that you are over the age of 18, that you are of sound mind, that you intend to continue to live in the UK, that you can prove that you can communicate in English to an acceptable degree, that you have passed a test called ‘The Life in the UK’ test, and that you are of good character.

Naturalization for EU Nationals

Once in possession of a permanent residence document, an EU national can make an application for naturalization and the requirements for this application are essentially the same for EU and non-EU citizens.

How long does it take to get a decision?

The Home Office guidance says 6 months but with citizen applications presentation and simplification is everything; with a good representation you may be able to get decision in 3 months

The public testing follows a successful private beta phase with employees in the higher education, health and social care sectors.
Immigration Minister Caroline Nokes said: Securing the rights of EU citizens living in the UK has always been our priority.
We are well on track to deliver a system that will make it easy and straightforward for them to obtain status once we have left the EU and continue to live their lives much as they do now.

This is a completely voluntary test phase, which will give us valuable insight into how the system works and if any changes need to be made before the full launch. The EU Settlement Scheme will be fully open by 30 March 2019, and EU citizens will have until 30 June 2021 to apply, in line with the draft Withdrawal Agreement.

The expansion has been announced through changes to the Immigration Rules. The Rules are accompanied by some initial findings of how the scheme performed during the second private beta test phase. Feedback during that phase, which ends on 21 December 2018, has so far been positive.

By 13 December 2018, more than 15,500 applications had been made and more than 12,400 of these had been concluded. 71% of the concluded applications were granted settled status and the rest were granted pre-settled status. Many of the applicants received their decision within 24 hours. We will publish a full report in January 2019.

The new, wider test phase will again require applicants to prove their identity by using the EU Exit: Identity Document Check app which is part of the integrated online application process. There will also be support for EU citizens who might need additional help in making their application.

The home secretary used his speech to the Conservative party conference to say people seeking British citizenship would face tougher English-language requirements, part of an immigration overhaul that will include the end of free movement from the EU.

In a broad speech set to intensify speculation about his leadership ambitions, Javid unveiled plans for a beefed-up “British values test” to replace the Life in the UK test for those looking to settle in the country.

Overnight, he and Theresa May had announced proposals for a single immigration system that treats people from EU countries the same as those from non-EU countries. Highly skilled workers who want to live and work in Britain would be given priority, while low-skilled immigration would be curbed.

Speaking later in an interview on the conference fringe with Viner, the home secretary said he was not concerned by the thought that under such a regime his father, who arrived from Pakistan in 1961 with £1 and no skills, would be barred from entry.

When his father came, Javid said, the entry system was very different as the governments of the time “wanted, needed, a route for low-skilled migration”.

Asked if it made him sad this would no longer be the case, he said: “No, it doesn’t make me feel sad. Actually, with today’s policy it makes me very optimistic about our future. Because what I have also set out is that we will remain the global-outlook nation that welcomes people from across the world, no matter where they’re from.”

In his speech, Javid announced plans aimed at improving integration and described the current Life in the UK test as a “pub quiz”.

“It’s about integration, not segregation,” he said. “And I’m determined to break down barriers to integration wherever I find them. Take, for example, the most basic barrier of all: language.”

Javid said 700,000 people living in the UK could not speak English.

“As home secretary, I will apply these principles to those who arrive in our country. So not only will there be a new values test but we will also strengthen the English-language requirements for all new citizens.”

Highly skilled migrants coming to the UK on a work visa will not face tougher language requirements than those already in place, the Guardian understands.

Javid said earlier he would consider scrapping the cap on the number of highly skilled migrants as part of the post-Brexit plan. The limit is currently 20,000.

Applicants will need to meet a minimum salary threshold – for highly skilled migrants this currently stands at £30,000 – but Javid has hinted that this will be reviewed.

In his speech in the main hall, the home secretary said: “Thanks to the [Brexit] referendum we now have a unique opportunity to reshape our immigration system for the future.

“A skills-based, single system that is opened up to talent from across the world. A system that doesn’t discriminate between any one region or country. A system based on merit. That judges people not by where they are from, but on what they can do.

“What people want – and they will get – is control of our own system. With a lower, and sustainable level of net migration. And, above all, that has to mean one thing: an end to freedom of movement.”

The government has said it intends to publish a white paper this autumn and a bill the following year, meaning it is highly unlikely MPs will get to vote on the legislation before the UK leaves the EU in March.

In the interview with Viner, Javid, who has previously spoken about how his mother did not learn to speak English until more than decade after she arrived in the UK, talked about his anger at the unfair targeting of people from the Windrush generation by immigration enforcement.

“The first thing that went through my mind is that it could have been my parents,” he said. “Imagine if this was my mum or my uncle, someone who had lived in Britain their whole life, contributed so much, being detained or, worse, removed from the country.”

But Javid vehemently rejected that the post-2010 Conservative government had been primarily responsible for the Windrush crisis with the so-called hostile environment policy, saying a lot of it had begun under Labour.

“If people portray this as a problem that happened under a Tory government, it’s incorrect. It’s either bad reporting or a deliberate attempt to twist the fact,” he said.

Javid, who again spoke about a range of subjects well beyond his official brief, was similarly blunt about Labour’s interventionist economic policies, saying: “The trouble is, Jeremy Corbyn really believes what he says. And he’s completely deluded.”

Elsewhere in his speech, he announced a package of new measures to tackle forced marriage, including proposals to refuse spousal entry to the UK where there is evidence a marriage is forced.

It will run from 1 November until 21 December with participating organisations focusing on EU citizens working in the health and education sectors.Unveiling the new scheme, the immigration minister, Caroline Nokes, said: “EU citizens make a huge contribution to our economy and we want them to stay.”

The Home Office will publish the findings from the first phase later this month but revealed that 650 EU citizens had applied. Registrations are expected to reach 1,000 by the end of the first test on 17 October.“Overall, the technology performed well, with some minor improvements identified to improve the overall customer experience,” Nokes said.An estimated 3.5 million to 3.8 million EU citizens in the UK will be required to apply for settled status post-Brexit.

Updating the government on the first pilot, the Home Office said the process took an average of 15 to 20 minutes to complete and nobody was refused their application for settled or pre-settled status, which applies to those who have been in the country for less than five years.But it said there were improvements to be made to the automatic data matching made against HMRC records and some of the language used in the application process.Campaigners such as the3million organisation and recruits in Liverpool have said the first phase should have gone well as all the recruits were highly educated and computer-literate.

The second phase will be critical in establishing how well the scheme works for the more vulnerable, with seven charities involved in the scheme.From 1 November the scheme extension will include three NHS trusts in Manchester in addition to the 13 participating in the north-west. From 15 November, applications will be taken on behalf of children in care in five local authorities in Kent, Lincolnshire, Sheffield and the London boroughs of Waltham Forest and Haringey.

Those eligible to apply include people receiving support from the Eastern European Resource Centre and Rights of Women and The Roma Support Group charities in London. From 29 November EU citizens working in any NHS trust in England can apply along with 16 other health institutes, including Public Health England and the Care Quality Commission.
Those in health boards in Wales, Scotland and in health and social care trusts in Northern Ireland can also apply during this phase as can any person employed in one of the 11 medical councils across the country.
